Title IX Rule Forcing Schools to Allow Boys in Girls’ Sports Gets Tossed Out

The Biden administration has finally pulled the plug on a highly controversial rule that would have mandated schools receiving federal funds to allow boys to compete in girls’ sports if they identify as female. This decision, scrapped just one month before President-elect Donald Trump returns to office, undoubtedly comes as a response to the wave of litigation and the fierce public backlash against the imposition of radical gender ideologies in public education.

The rule in question was an egregious reinterpretation of Title IX of the Education Amendments of 1972. Title IX was designed to prevent discrimination based on sex, not to be manipulated into a tool for enforcing radical and destructive ideological agendas. Yet, under Biden, it was contorted to push policies that blur biological realities and ignore the genuine concerns and safety of female athletes.

Thankfully, common sense prevailed in the judiciary, with at least seven circuit courts deeming the reinterpretation of Title IX as potentially unconstitutional. These courts have halted its application across 26 states, recognizing that forcing girls to compete against biological males is not just unfair, it’s downright discriminatory.

This judicial pushback culminated in a Supreme Court decision this past August, which upheld temporary injunctions against the application of these misguided rules, particularly concerning transgender access to school bathrooms that align with their gender identity rather than their biological sex.

In withdrawing this rule, the Department of Education admitted to “multiple pending lawsuits” and an overwhelming tide of public opposition. This isn’t surprising. When you attempt to enforce policies that fly in the face of biological science and encroach on the rights and safety of students, pushback is inevitable—and necessary.

What’s telling about this entire debacle is the timing. The rule’s withdrawal was strategically delayed, buried in bureaucratic language and quietly announced to minimize attention. Yet, even in retreat, the administration’s notice acknowledged the complexity and contentiousness of imposing such a rule without sufficient legal or public support.

This episode is a glaring example of how out of touch the Biden administration is with the American people. As Trump prepares for his second term, it’s crucial to recalibrate the federal approach to education, emphasizing biology and fairness in sports over ideological compliance. Let’s hope this marks the beginning of a broader rollback of policies that put political correctness above practical reality.
