Chicago Judge Says Illegal Immigrants Have Second Amendment Rights

U.S. District Court Judge Sharon Coleman ruled that an illegal immigrant in possession of a handgun was exercising his Second Amendment right.

In a move that has conservatives across the nation shaking their heads in disbelief, U.S. District Court Judge Sharon Coleman, an Obama-era appointee, made a jaw-dropping decision by dismissing gun charges against an illegal immigrant on the grounds of the Second Amendment. This ruling, favoring Heriberto Carbajal-Flores, who was apprehended with a handgun in the streets of Chicago’s Little Village in June 2020, overturns decades of legal precedent and stretches the Constitution to its breaking point.

Coleman’s ruling asserts that Carbajal-Flores, despite his illegal status, retains the right to self-defense, including the possession of a firearm. This assertion flies in the face of federal laws that unequivocally prohibit noncitizens without legal U.S. presence from owning guns. The justification? Carbajal-Flores claimed he needed the gun for personal protection during the wave of civil unrest in 2020.

This bewildering stance from Judge Coleman not only tramples on the clear letter of the law but also opens a Pandora’s box of legal and ethical dilemmas. If illegal immigrants are now to be afforded Second Amendment rights, what does this say about the rule of law, the importance of citizenship, and the integrity of our national borders?

This decision starkly highlights the double standards at play. Law-abiding U.S. citizens are currently navigating a minefield of regulations and challenges to exercise their constitutional right to bear arms. Yet, according to Coleman’s logic, illegal immigrants might bypass these hurdles and claim these rights without the responsibilities and legal standing that come with citizenship. 

We find ourselves at a crossroads, with this ruling serving as a potential harbinger for how Second Amendment rights and immigration laws could be reinterpreted and applied in the future. This is a potential precedent that threatens to erode the foundations of our legal system and the sanctity of American citizenship.

We must stand firm against this encroachment on our constitutional rights and the undermining of our nation’s laws. The fight for the Second Amendment and the defense of our borders are intrinsic to preserving the sovereignty, security, and fundamental principles of the United States. Let’s be clear: the path Judge Coleman is leading us down is one of lawlessness and confusion, where the rights of illegal immigrants overshadow the rights and safety of American citizens. It’s a path we cannot afford to take.
